156 Rogers Report on Pennoyer Distribution

In pursuance of a Decretal Order bearing date the 7th day of March in the 5th year of the Reign of her present Majestie Queen Anne and other subsequent Orders dated the 25 March and 26 May 1706 I have been attended by Mr. Snow Clerk in Court for the Plaintiff and by Mr. Daniel Russell Sollicitor for the Defendants the Trustees and by Mr. Stacy Sollicitor for the Defendants Samuel Crispe and by William Parker Sollicitor for Joshua Blackwell former and Mr. Robert Bransby the present Receiver of the Rents of the said Trust Estate, and have taken an account of the Rents and Proffits of the Trust Estate mentioned in the Decretal Order which came to the hands or use of Samuel Crispe late Father of the Defendant Samuel Crispe and find the same amounts to £1625.17s.9d and no more, and that the said Samuel Crispe his said late Father and this Defendant Samuell his only Acting Executor have necessarily disburst expended and paid relating to the management of the said Estate the Summe of £1528.10s.7d. And I have taxed the said Defendant Samuel Crispe his costs of this Suite at £32.19s.4d which said costs and Disburstments being added together make the entire Summe of £1561.9s.11d which being deducted out of the said £1625.17s.9d reduces the same to the sume of £64.7s.10d neate money to be paid by the said Defendant Samuel Crispe out of the assetts of his said Father. And I have taken an account of the Rents and Profitts and Disburstments of the Trust Estate, from Michaelmas 1705 to Michaelmas 1707 from Joshua Blackwell the late Receiver and find that within the compass of that time, the said Josuah Blackwell received out of the Profits of the said Estate, the Sume of £392 and no more and hath within the said time Disbursed the summe of £58.14s.5½d which with his salary of £20 per Annum for two years being deducted out of the said Receipts reduceth the same to the summe of £293.5s. 6½d neat Money in his hands. And I have also taken an Account from the said Robert Bransby the present Receiver of the Rents of the said Trust Estate from Michaelmas 1707 to Michaelmas 1708 and find that he hath received £196 and that the Disburstments thereout and arrears of Rent amounts to £79.7s.2d which being taken out of his said Receipts maketh the Neat Summe remaining in his hands £116.12s.10d. And I have considered of the plaintiffs and defendants several Bills of Costs in this Cause the plaintiffs Bill of Costs amounting to £120.11s.11d which I have taxed at £102.2s.5d, The Defendants Bill of Costs amounting to £21.14s.10d which I have taxed at £17.13s.0d both which being deducted out of the said £293.5s.6½d neat money now remaining in the said Joshua Blackwell’s hands reduceth the same to the summe of £173.10s.1½d which with the £64.7s.10d in the Defendant Crisp’s hands and the said £116.12s.10d amounting together in the whole to the summe of £354.10s.9½d is to be paid and distributed according to the proportions mentioned in the Schedule hereto annexed pursuant to the Will of William Pennoyer Esquire Deceased, and the Directions of the said Decretal Order, and in Testimony that this report passed by consent or approbation of all the said parties they or their said Clerks or Sollicitors have subscribed a true copy thereof entered in a book kept by me for that purpose, all which I humbly certifie and submit to the Judgment of this Honourable Court.
